INFORMATION ON THE PROCESSING OF PERSONAL DATA<\/strong><\/p>

This notice describes how the personal data of users who visit sartoriaequestre.com and of customers who make purchases are processed, pursuant to Regulation (EU) 2016\/679 (GDPR) and Italian Legislative Decree 196\/2003.<\/p>

DATA CONTROLLER<\/strong><\/p>

The Controller has not appointed a Data Protection Officer (DPO), as the legal requirements for such an appointment are not met.<\/p>

TYPES OF DATA PROCESSED<\/strong><\/p>

Browsing data. During their normal operation, the IT systems of this website acquire certain data whose transmission is implicit in the use of the internet, such as IP address, browser type, access times and pages visited. This information is necessary for the use of the website and for its security.<\/p>

Data provided voluntarily. This is the data provided by the user to make a purchase (name, surname, shipping and billing address, email, telephone number), to create an account or to contact the Controller through the forms on the website or by email.<\/p>

Payment data. Card details and other payment instrument data are processed directly by the payment service providers and are never stored on the Controller’s systems.<\/p>

PURPOSES AND LEGAL BASES OF PROCESSING<\/strong><\/p>

Data are processed for order management, namely for the conclusion of the contract, payment, shipping, invoicing, after-sales support and the handling of returns and withdrawal. The legal basis is the performance of a contract (Art. 6(1)(b) GDPR).<\/p>

Data are also processed to comply with the tax, accounting and legal obligations to which the Controller is subject. The legal basis is a legal obligation (Art. 6(1)(c) GDPR).<\/p>

The management of the customer account and the handling of contact and support requests are based on the performance of a contract or of pre-contractual measures taken at the data subject’s request (Art. 6(1)(b) GDPR).<\/p>

Website security, the prevention of fraud and abuse and the defence of the Controller’s rights in and out of court are based on the Controller’s legitimate interest (Art. 6(1)(f) GDPR).<\/p>

The provision of data for contractual purposes is necessary: without it, it is not possible to complete the purchase or provide the requested service.<\/p>

RECIPIENTS OF THE DATA<\/strong><\/p>

Data may be disclosed to parties performing activities necessary for the performance of the contract, appointed where required as data processors pursuant to Art. 28 GDPR: the website hosting provider; shipping service providers, including the Packlink PRO platform (Auctane S.L.U., Paseo Imperial 14, Madrid, Spain) and the couriers entrusted with delivery; payment service providers; the Controller’s tax, accounting and legal advisors; providers of technical and website maintenance services.<\/p>

Data are not disseminated nor transferred to third parties for commercial purposes.<\/p>

TRANSFERS OUTSIDE THE EU<\/strong><\/p>

The use of certain technical services may involve the transfer of data to countries outside the EU, in particular the United States. In such cases the transfer takes place on the basis of adequacy decisions of the European Commission or of standard contractual clauses, with the safeguards provided for by Articles 44 et seq. of the GDPR.<\/p>

DATA RETENTION<\/strong><\/p>

Data relating to orders and invoicing are kept for 10 years from the conclusion of the contract, in compliance with civil law and tax obligations.<\/p>

Customer account data are kept until the account is deleted by the user.<\/p>

Data collected through contact requests are kept for the time necessary to process the request and for any follow-up.<\/p>

Browsing data are kept for the time strictly necessary for security purposes.<\/p>

RIGHTS OF THE DATA SUBJECT<\/strong><\/p>

Pursuant to Articles 15 et seq. of the GDPR, data subjects have the right to obtain access to their data, rectification, erasure, restriction of processing and data portability, as well as to object to processing based on legitimate interest.<\/p>

Requests may be sent to orders@sartoriaequestre.com or to the certified email address sartoriaequestre@mailcertificata.org. The Controller replies within one month of receipt of the request.<\/p>

COMPLAINTS TO THE SUPERVISORY AUTHORITY<\/strong><\/p>

Data subjects who believe that the processing of their data infringes applicable law have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it) or with the supervisory authority of the Member State in which they reside or work.<\/p>
